Germany declares housebuilding an 'overriding public interest'
GermanyWestern EuropeOn the globe
The German federal government has passed a reform of its planning and building law (Baurecht) under the banner 'Wohnen hat Vorfahrt' ('Housing has right of way'). The reform speeds up approval procedures, streamlines building-plan processes, and explicitly designates housing construction as an 'overriding public interest' in areas with tight housing markets — giving it greater legal weight than competing planning considerations.
The legislation also gives municipalities new powers to address vacant properties. The move is one of the clearest examples yet of a national government using planning law itself, rather than just funding or targets, to tilt the balance decisively toward new housing supply.
